A mitigation evaluation is a thorough assessment of an individual's background, exposure to violence or trauma, and current intellectual and psychological functioning which may have played a meaningful role in their alleged offense conduct. A mitigation report can assist attorneys and the courts to better understand psychological factors leading to an offense and how these factors may be relevant to judicial decisions.
A competency (competency to stand trial/aid and assist/fitness to proceed) evaluation is a comprehensive assessment of whether or not an individual, as the result of a qualifying mental disorder, is unable to understand the nature of the proceedings against them, assist and cooperate with counsel, or participate in their own defense. The goal of a competency evaluation is to facilitate the legal decision maker by providing a description of case-related functioning, any impairment to that functioning, and associated causes of any impairment.
The goal of a criminal responsibility (guilty except insane) evaluation is to facilitate the legal decision maker by providing an opinion as to whether the individual (defendant), as a result of a qualifying mental disorder at the time of engaging in the alleged criminal conduct, lacked substantial capacity to appreciate the criminality of their conduct; as well as an opinion related to whether they lacked substantial capacity to conform their conduct to the requirements of law.
Dr. Merg earned her doctorate at APA-accredited Fielding Graduate University in Santa Barbara, California. Her emphasis was in clinical psychology with a concentration in social justice and diversity. Dr. Merg completed a one-year APA-accredited internship through the Immaculata Consortium at Joseph J. Peters Institute Safety and Responsibility Program which focused on specialized assessment and treatment of court-mandated individuals who engaged in problematic sexual behavior and relational violence. She also conducted specialty assessments addressing risk for future offending for adolescents who engaged in problematic sexual behavior. Prior to completing her doctorate, Dr. Merg worked with children, adolescents, and adults in inpatient, outpatient, and community settings. She completed undergraduate and master’s degree studies in behavioral science and psychology.
Dr. Merg has specialized training in assessment, diagnosis, psychotherapy, and research in clinical psychology from the lens of cultural humility, social justice, and diversity. She is a licensed psychologist in the State of Oregon and an Oregon Certified Forensic Evaluator. She has special interests in parents involved in the criminal justice system as well as in the intersection of mental health and criminal justice. It is her intention to promote recovery, resilience, and community safety through clinical, actuarial, and research-based assessments and recommendations.
Dr. Merg is a member of the American Psychological Association, Oregon Psychological Association, and the Association for the Treatment of Sexual Abusers.
